INSCHOOL ONLINE TOOLS (IOTs)

Terms and Conditions

By accessing and using the INSCHOOL AUSTRALIA IOTs, you accept and agree to be bound by these Terms and Conditions.

DO NOT USE THE USE OR ACCESS INSCHOOL AUSTRALIA IOTs IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS.

These terms and conditions are binding on all persons who access and/or use the INSCHOOL AUSTRALIA IOTs.

If you do not wish to be bound by these terms and conditions, do not access or use the IOTs.

Your right to access and use the IOTs is dependent upon your agreement to these terms and conditions.

Any information provided by individuals using the IOTs will be treated as confidential and INSCHOOL AUSTRALIA will use reasonable efforts to ensure such information is kept and used in accordance with the National Privacy Principles, INSCHOOL AUSTRALIA's privacy guidelines, and stored by INSCHOOL AUSTRALIA in a safe harbor compliant environment.

Registration

By registering, a user of the IOTs, agrees to receive email communication from INSCHOOL AUSTRALIA. Email addresses may be used to provide a user with more information concerning their registration and participation in the IOTs and to advise users of other matters that INSCHOOL AUSTRALIA considers may be of use, or interest, to such persons.

The IOTs have been designed for, and are offered by INSCHOOL AUSTRALIA solely for use by teachers and persons who are pre-service teachers.

By using, or accessing, the IOTs, you agree to each of the following terms and conditions:

  • you agree that, for the purposes of the Institute-registered professional development course and use of IOTs, all answers collected from the IOTs will be seen as confidential to the participant.
  • you agree that, for the purposes of whole school reporting for performance and development related to the user and/or recruitment information related to the user, INSCHOOL AUSTRALIA will obtain the permission from the user concerned for any use sort of the answers from the IOTs . For the particular purpose of job patterning, INSCHOOL AUSTRALIA will use reasonable efforts to ensure that no individual will be identified in the report.
  • you may be contacted by INSCHOOL AUSTRALIA to provide feedback on your experience in using the IOTs. If INSCHOOL AUSTRALIA wishes to publish this feedback to help promote the IOTs (otherwise than in a de-identified form), INSCHOOL AUSTRALIA will obtain the permission of the user concerned.
  • you agree that INSCHOOL AUSTRALIA may, and is entitled to appoint a third party provider to:
    • examine and use data provided by you as part of, or in connection with the IOTs for the purposes of storing, maintaining and managing that data
    • examine and use Data to review and make updates and refinement of the IOTs
    • store, maintain and manage Data
    • use and publish de-identified Data for research and other educational related purposes.
  • you acknowledge and agree that completion of the IOTs is only a general indicator of a user's performance and may not (and will not) be relied on by you for any purpose (including any purpose related to the performance of the user as a teacher, whether in relation to the Australian Professional Standards for Teachers or otherwise).
  • you acknowledge and agree that the IOTs are not a definitive statement of a user's performance against the Australian Professional Standards for Teachers or any other standards.
  • you acknowledge and agree that the results of the IOTs do not provide a definitive statement of readiness for applying for, or likelihood of success of achieving national certification.
  • you will use the IOTs strictly in accordance with any applicable law.
  • you will not upload onto the IOTs (or use in connection with the IOTs) any information or other material which:
    • breaches any applicable law
    • is obscene, offensive, racist, threatening or harmful to any group or individual
    • contains personal information about any individual (other than you) or invades the privacy of anyone
    • is defamatory, false or misleading or otherwise damaging to any corporation, group or individual, or to other users of the IOTs
    • breaches any third-party's copyright or other intellectual property rights
    • contains computer viruses, malicious computer code or other forms of interference which may damage computer systems or databases (Viruses) or
    • contains political or commercial messages.
  • in using the IOTs, you will not:
    • breach any obligations of confidence owed to any person;
    • breach any law, regulation or contractual obligation you owe to a third person
    • access, tamper with or otherwise use areas of the IOTs, (including without limitation, any computer code underlying, running or managing the online tool) otherwise than to insert material as expressly authorised in these Terms and Conditions or in undertaking the self assessment activities contemplated by the IOTs.
    • email to INSCHOOL AUSTRALIA, transmit or otherwise make available or use any content which
    • is in breach of the undertakings made by you in these Terms and Conditions; or
    • contains any Viruses:
    • decompile, reverse engineer or disassemble any software, device or other processes forming part of, or used in connection with, the IOTs.
  • you acknowledge and agree that (as between you and INSCHOOL AUSTRALIA), INSCHOOL AUSTRALIA is the owner of all copyright and any other intellectual property rights subsisting in the IOTs and in any material or other matter (including, without limitation, any software) or thing comprising the IOTs or any other material generated through use of, or by, the IOTs (or Related Matter) and that you will not use or reproduce the online tool or any Related Matter otherwise than strictly for the purpose of undertaking the self assessment activities contemplated by the IOTs.
  • you acknowledge and agree that you are solely responsible for all information that you upload or provide as part of, or in connection with the IOTs.
  • you acknowledge and agree that INSCHOOL AUSTRALIA provides the IOTs on an as is basis and without any warranty or representation:
    • as to its efficacy of the IOTs
    • that the IOTs will meet your requirements
    • that the IOTs does not contain any defects, faults or malfunctions or Viruses
    • that use of the IOTs will be error free
    • that the IOTs will be operative at all times
    • that the IOTs or use of it will not infringe or otherwise violate the rights (including intellectual property rights or Moral Rights) of any person.
  • you hereby release and indemnify and will keep released and indemnified INSCHOOL AUSTRALIA and each of its officers, employees, agents, contractors and representatives now (and in the future) in respect of any and all damages, losses, penalties, fines, expenses and costs (including legal costs on a full indemnity basis) which arise out of, in connection with, or relate to
    • your use of these IOTs
    • any information that you provide as part of, or in connection with, the IOTs or
    • any damage that you may cause to the IOTs.

You acknowledge and agree that the indemnification provided by you includes, without limitation, any and all liability that may arise in respect of, relating to, or in connection with copyright infringement, defamation, invasion of privacy, trademark infringement and breaches of the Competition and Consumer Act 2010 (Cth).
